Abstract:
The purpose of this paper is the formulation and study of theoretical and legal problems associated with the interaction of international and domestic law in the field of human rights protection. The study used scientific methods: dialectical, statistical, system, method of modeling, abstraction, historical, legal, formal and dogmatic, comparative law, legal method of forecasting. Findings of the study can be used in the formulation and solution of a number of un explored problems in the theory and practice of international law: the implementation of human rights, enforcement in dependent national courts of decisions of international courts. Exploring the international and domestic norms, the author presents his own vision of these problems and approaches to their solution. The paper develops the idea that the human rights of one of the forms of interaction between international and domestic law is to prevent and resolve conflicts between them. Results of the study may be useful for the practice of the domestic implementation of international human rights law; further improvement of the rule-making process; preparation of international treaties and federal laws; activities of public authorities.
