Abstract:
Problem: The article is devoted to the problem of indentification of the super-imperative rules of private international law. Novelty and actuality of this issue caused the preparation of this article. Upon investigating the issue the writings of the following authors have been studied: M. McParland, N. Nord, G. Ruhl, V.L. Tolstych etc. Model: The present article is dedicated to the examination of the main criteria of the super-imperative rules, which allow to make a distinction between super-imperative rules and ordinary mandatory rules. Conclusion: The author makes conclusion on the main characteristics of the super-imperative rules of Russian law, main and supplementary criterion of the super-imperative (overriding mandatory) provisions of European Union`s law, proposes the definition of super-imperative rules of Russian law.
