Abstract:
The article analyzes the normative legal acts establishing such objects of civil rights as acreages, the ground area, the artificial ground area and other objects related to the real estate by the legislator. A comprehensive review of the theoretical and practical aspects of the category of real estate in terms of reforming of the civil, land and town-planning legislation, as well as their application made it possible to formulate the notion of the ground area as the main classifier of things to movable and immovable, also stemming the concept of real estate. The analysis has been made to other real estate that is classified as such under applicable law, including taken from materials of judicial practice. From the analysis of judicial practice, which prove the main characteristic of strong bond with the earth's surface and the time of occurrence of such communication to man-made real estate, also it was concluded about the conventions of such a physical characteristic of the real estate boundaries. Category purpose of the immovable seems valuation and contingent, since it may vary according to the legislation, without prejudice to such object. In the process of research on the concept of real estate and its species classification, we used the general and private methods of cognition: historical-legal, formal-legal, comparative legal, sociological and other. Main method performed in a system-structural, which helped to identify the legal nature of the category of real estate in civil law, as well as its signs. The inclusion in the civil law concepts of real estate will fill the theoretical gap and will more accurately classify objects on movable and immovable. The signs of the real estate will clarify, and in some cases revise the existing definitions of the kinds of real things that will undoubtedly contribute to deeper learning and understanding
