The article presents an analysis of the problems of protection of the rights holders at the conclusion of preliminary contracts of sale of apartments or non-residential premises in place agreements on share participation in the construction phase. Given the risks of the purchase of apartments on the «gray» schemes . So, given the jurisprudence on recognition by the courts of preliminary contracts of a joint construction contracts DDU, addresses the issue of violations in connection with fundraising for the construction of a preliminary contract of sale of real estate or preliminary contract of a joint construction, analyzed the application of administrative responsibility in the shared construction of a way to protect the rights of shareholders. Legislation enshrined increased demands on the developers, the content and execution of the contract of a joint construction, attracting funds of citizens for construction. However, the protection of the rights holders problem is now not lost its relevance. Existing gaps in the legislation in this regard, the lack of well constructed system of legal regulation leads to numerous violations of the rights and interests of stakeholders.
