Abstract:

There is considered the question of consequences of transaction's part invalidity. The author analyzes development of idea about admissibility of recognition the transaction's part invalid in the Roman private law, pre-revolutionary, Soviet and modern Russian civil law and pays attention to presence at courts of large powers at application of article 180 of the Civil Code of the Russian Federation which have to be used taking into account need of ensuring balance of public and private interests.
