Abstract:
Purpose - research of problems of development of legal proceedings during an era of "the educated monarchy". Methodology - the analysis of approaches and views of researchers of development of lawsuit at a turn of two centuries when attempts of liberalization of the public relations were made. Results - in article features of treatment of changes of elements of judicial proceedings in a transition period from an absolute monarchy to "educated" are analyzed. Originality / value: this article touches on the issues assuming need of the analysis of a question of degree independence of the monarchic power in respect of the potential opportunities of destruction which developed in the society of ideas of the basic principles of judicial proceedings in Russia
