Abstract:
Changes of the civil legislation must be based on theoretical developments and proposals of scientists. Despite the problems uncovered in the division of legal entities on commercial and non-profit organizations, they did not find their solution in the draft amendments of the Civil Code of the Russian Federation. The lack of an adequate response from the part of the legislator to the decision of questions of development of system of legal entities could lead to further aggravation of contradictions between the «civilistic» approach to the definition of ratios volume of the concepts of «legal person» and «organization» and those developments, which are currently underway in the science of business law. Achieving consensus and finding common points of contact between the data of the scientific and practical approaches would have a favorable impact on the development of legislation in Russia on legal entities and law-enforcement practice.
